The Poker Brothers

Terms of Use

Last updated: September 18, 2026

These Terms govern your use of The Poker Brothers mobile app (“the app”), operated by ICS (“we”, “us”). By creating an account, continuing as a guest or otherwise using the app, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the app.

1. Eligibility

You must be at least 18 years old and the age of majority where you live. The app isn’t offered where its use would be unlawful.

2. Education only — no gambling

3. Your account

4. Subscriptions and purchases

5. Your license and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the app for your own non-commercial training. You must not:

6. Community guidelines

The community is a place for poker players to share goals, questions and feedback. There is zero tolerance for objectionable content or abusive users. You must not post:

Reporting, blocking and enforcement

Tap ⋯ on any post to report it or block its author. We review reports within 24 hours and remove content that breaks these guidelines. We may suspend or permanently ban accounts that break them — without notice for serious violations. Posts are also screened automatically before they’re published.

Your content

You keep ownership of what you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display and reproduce it within the app so we can operate the community; this ends when the content is deleted, except for copies kept as described in the Privacy Policy. You’re responsible for what you post, and posts are visible to other users. If you send us feedback or suggestions, we may use them without any obligation to you.

7. Our content and trademarks

The app and its content — including lessons, drills, ranges, graphics and the name “The Poker Brothers” — belong to us or our licensors and are protected by law. Other names and trademarks mentioned in the app belong to their owners; mentioning them doesn’t imply endorsement.

8. Analytics and diagnostics

To keep the app working and decide what to improve, we record how it is used — which screens, lessons and drills are opened and completed, and how sessions score — together with a history of your own training sessions, and we receive automatic crash reports when the app fails. This is part of how the service operates and cannot be switched off inside the app. We don’t use it for advertising and we don’t track you across other companies’ apps or websites. What is collected, how long it is kept and the rights you have over it are set out in our Privacy Policy; deleting your account removes your data as described there.

9. Third-party services

The app relies on third-party services such as the Apple App Store, Google Play and Google Firebase — including Firebase Authentication, Cloud Firestore, App Check, Google Analytics for Firebase and Crashlytics — whose own terms apply. We aren’t responsible for third-party websites or services linked from the app.

10. Changes to the app

We may add, change, suspend or remove features and content at any time. We don’t guarantee the app will always be available or error-free.

11. Termination

You can stop using the app and delete your account at any time. We may suspend or end your access if you break these Terms or if we must for legal reasons. Sections that by their nature should survive — such as sections 6 (Your content), 7, 11, 12, 13 and 15 — continue after termination.

12. Disclaimers

To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, including accuracy, fitness for a particular purpose, or results at the tables. Nothing in these Terms limits rights you have under mandatory consumer protection law, including Brazil’s Consumer Defense Code (Código de Defesa do Consumidor).

13. Limitation of liability

To the fullest extent permitted by law, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for losses arising from poker or gambling decisions. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or USD 50 if you paid nothing. Some jurisdictions don’t allow these limits, so they may not apply to you.

Nothing in these Terms limits liability that cannot be limited by law, including for fraud, gross negligence or willful misconduct, or your rights under mandatory consumer protection laws.

14. Indemnity

To the extent permitted by law, you agree to indemnify us against claims arising from your content or your breach of these Terms.

15. Apple App Store terms

If you downloaded the app from the Apple App Store:

  1. These Terms are between you and us, not Apple. Apple isn’t responsible for the app or its content.
  2. Your license is limited to using the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  3. Apple has no obligation to provide maintenance or support for the app.
  4. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  5. Apple isn’t responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims.
  6. Apple isn’t responsible for investigating, defending, settling or discharging any claim that the app infringes a third party’s intellectual property rights.
  7. You confirm that you aren’t located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you aren’t on any US Government list of prohibited or restricted parties.
  8. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Governing law and disputes

These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules, and disputes will be heard by the courts of Itajuba, Brazil. If you’re a consumer, you keep the protection of the mandatory laws of the country where you live and may bring claims in your local courts. Before starting a dispute, please contact us so we can try to resolve it informally.

17. Changes to these Terms

We may update these Terms. We’ll change the date above and, for material changes, let you know in the app before they take effect. Continuing to use the app after that means you accept the updated Terms.
